Food Safety and Standards (Packaging and Labelling) First Amendment Regulations, 2020

The Food Safety and Standards Authority of India amended the Food Safety and Standards (Packaging and Labelling) Regulations, 2011, which may be called the Food Safety and Standards (Packaging and Labelling) First Amendment Regulations, 2020.

The regulations are in force since 21st August 2020 & FBO will have to comply with all the provisions of these regulations by 1st January, 2022. Compliance before this date is voluntary. This amendment is applicable to Food Service Establishment who is now have to display the information as given below. The establishment which fall under this amendment are

  1. Food service establishments having central license or outlets at 10 or more locations
    1. Shall mention the calorific value (in kcal per serving & serving size) against the food items displayed on the menu cards or boards or booklets & the reference information on calorie requirements shall also be displayed clearly & prominently as “An Average active adult requires 2,000 kcal energy per day, however, calorie needs may vary”.
    2. Shall mention information
      1. Relating to allergens, if food contains any
      2. Logo for vegetarian or non-vegetarian
    3. If applicable, food service establishments shall also provide nutritional information as given under
      1. Clause (3) of sub-regulation 2.2.2
      2. Clauses (18), (25), (38), (46), (47), (48) of sub-regulation 2.4.4
      3. Information relating to organic food or ingredients, if claimed, for the food items sold by them to consumers upon request in the form of booklets or handouts or on their website
    4. Deviation of 25% may be tolerated in case of nutritional information declaration.
  2. E-commerce FBOs shall get information referred to the above from respective FBO & provide on their website wherever applicable.
  3. The provisions of this regulation shall not be applicable to the following:
    1. Event caterers & food service premises that operate for less than 60 days in a calendar year (consecutively or non-consecutively)
    2. Self-serve condiments that are free of charge & not listed on the menu
    3. Special-order items or modified meals & menu items as per request of the customer.
  4. Other food service establishments also will have to comply with the requirements stated in these regulations, if specified by the FSSAI from time to time.
