Appeal procedure specified in FSS (Approval for Non- Specified Food and Food Ingredients), Regulations 2017
Through an order dated 15th December 2021, FSSAI has clarified that in case if the license application has been rejected, the FBOs can now file an appeal before the CEO of Food Authority against the decision of rejection within 30 days of receiving the rejection letter and such appeal should be addressed within 30 days from the receipt. In case if the CEO has rejected the appeal, then the FBO may file a review petition before the Chairperson of the Food Authority within 30 days, and the decision of the Chairperson will be regarded as final.
